Prior declaration of posting to Italy, when and what to file

The prior declaration of posting is the first thing the Italian administration expects from a foreign company. Article 10(1) of Legislative Decree 136/2016 requires filing it by midnight of the day before the posting starts, and notifying any later change within five days. The posting may be perfectly genuine, yet if the declaration is missing or late the fine applies anyway, per worker.

Who must file the prior declaration

The duty covers every company established abroad posting to Italy under a service or works contract, within a group, or as a transnational temporary work agency. It also covers companies established outside the EU. The duty sits with the posting company and cannot be delegated to the Italian client, who nonetheless suffers the consequences of an omission.

The only exception is road transport, where posted drivers follow a dedicated European declaration channel under Directive (EU) 2020/1057, with its own rules and deadlines.

What it must contain and when to update it

The declaration identifies the posting company, the number and identity of the workers, start and end dates, the place of work, the recipient of the services, the type of services, the contact person domiciled in Italy and the home-country social security position. Agency posting adds the authorisation details. Filing procedures are set by Ministerial Decree 170/2016 with a dedicated form.

Any relevant change, from dates to names, must be notified within five days. A declaration never updated is, for the changed part, equivalent to a missing one.

In transnational agency work the duty falls on the foreign agency, which must also state its authorisation details, while the Italian user has a direct interest in demanding proof, because every gap resurfaces in site or plant inspections. The declaration is also the anchor of the other duties, the contact person and the documentation file are checked starting from the data declared.

What happens if it is missing or incomplete

The breach carries an administrative fine of 180 to 600 euros per worker concerned, within the overall cap of 150,000 euros set by Article 12. With ten workers a mere delay starts at 1,800 euros and can exceed 6,000.

There is a less visible effect too. Inspection bodies make an overall assessment of all the elements of the case when testing whether a posting is genuine (Article 3(1), Legislative Decree 136/2016), and an omitted or late declaration is among the first elements steering that assessment the wrong way.

Frequently asked questions

Is the declaration needed for postings of just a few days?

Yes. The law sets no minimum duration, the duty arises with the first day of activity in Italy.

Must it be redone if dates or workers change?

Changes must be notified within five days. The part left un-updated is finable as if never declared.
