Posting documents for Italy, which ones and for how long

Posting documents are not needed the day the worker arrives, they are needed the day someone asks for them, in an inspection, in a compliance check or at the client's request. Italian law demands a precise file, in Italian, available during the posting and up to two years after it ends (Article 10(3), Legislative Decree 136/2016).

Which documents must exist

The duty is to keep, with a copy prepared in Italian, the employment contract or an equivalent document with the information required by Legislative Decree 152/1997, together with payslips, records showing start, end and duration of daily working time, proof of wage payments, the public notice of engagement or equivalent, and the social security certificate, for EU countries the A1.

Each document tells part of one story. The contract says what terms were promised, payslips and time records say what was applied, payment proof says whether it was applied for real. Inconsistencies across these three layers are the classic attack point of an investigation. For working time, site registers and clocking systems also matter, inspectors match them against the records produced.

The Italian copy is not a detail

The Italian copy is part of the duty, not a courtesy. Documents produced only in the home language expose the company to the same fine as non-retention and stretch inspection timelines, while the case stays open.

Fines and the two-year window

Breach of the documentation duties carries a fine of 600 to 3,600 euros per worker concerned, within the overall cap of 150,000 euros. With twenty workers a missing file starts at 12,000 euros.

The two-year window after the posting ends is the part that slips most often. A company that has closed the job and archived the case must still be able to produce everything through the contact person domiciled in Italy, who remains required for the same period.

Beyond the mandatory core it pays to be able to produce what reconstructs the context, the receipt of the prior declaration, the service or works contract justifying the presence in Italy and the appointment of the contact person. Not all of these are fined as such, but their absence forces the investigation to widen.

Frequently asked questions

Are documents in the home language enough?

No. The law requires preparing an Italian copy of the file, and a missing copy equals a missing document.

Must the documents physically sit on site?

The law imposes retention and availability, not a physical place. What matters is being able to put them before Italian enforcement, in useful time, through the contact person.
