Posted worker pay in Italy, what must be guaranteed
Pay is where almost every posting dispute in Italy is fought. The rule sits in Article 4 of Legislative Decree 136/2016, posted workers are entitled, during the posting and where more favourable, to the same working and employment conditions provided in Italy by law and collective agreements (Article 4(1)). Since Directive (EU) 2018/957 the principle is the same pay for the same work in the same place.
What counts towards the pay to be guaranteed
The comparison is not with the bare minimum wage scale. It covers every element made mandatory by law and by the collective agreement applicable to the work performed, signed by the comparatively most representative organisations, including periodic and deferred items accruing over the posting.
Posting allowances paid under home-country rules count only for the part that does not reimburse travel, board and lodging. Where the applicable terms do not distinguish the two components, the Directive requires treating the entire allowance as expense reimbursement, hence outside the pay comparison.
Not only pay, hours, rest and housing
Equal conditions also cover maximum working time and minimum rest, paid annual leave, health and safety, protection of pregnant workers and minors, housing conditions where provided by the employer, and allowances for travel required during the posting within Italy.
The comparison is not a one-off exercise. Collective renewals, periodic increases and deferred entitlements move the benchmark during the posting, and past twelve months of actual duration the scope widens to all Italian working conditions, as covered in our article on long postings.
What underpaying against Italian standards costs
The pay differential is a worker's credit that inspectors can quantify and make enforceable through the assessment order under Article 12 of Legislative Decree 124/2004. The Italian principal is jointly liable within the limits of Article 1676 of the Civil Code and Article 29(2) of Legislative Decree 276/2003, both applied to postings by Article 4 of Decree 136/2016.
Underpayment against host-country standards is also among the first items examined by European posting inspections, as the coordinated construction checks show.
Frequently asked questions
Does the home posting allowance cover the gap with the Italian collective agreement?
Only for the part that is not reimbursement of travel, board and lodging. Absent a clear distinction, the whole allowance counts as reimbursement and stays out of the comparison.
Which collective agreement is the benchmark?
The one for the sector of the work actually performed in Italy, signed by the comparatively most representative organisations. Identifying the right agreement is the first and most delicate step of the whole comparison.
